In Short – The only survivor of a 14-tree grove called the Council Oaks by local Indians, legend has it that the tree marks the spot where Stephen F. Austin signed the first boundary treaty with Texas' Native Americans. As the 20th century began, the Council Oaks fell prey to Austin's urban expansion, making this the last tree by the '20s. It was then saved and added to the American Forestry Association's compilation of famous trees.

- In 1989, the tree was deliberately poisoned, and the story found its way onto the front pages of international newspapers and magazines. Ross Perot issued a blank check to help save the tree, and in 1997, the Treaty Oak produced acorns for the first time.
